Un risque pour le travailleur\u2026 et l\u2019employeur<\/strong>.<\/p>\n\n\n\n<p>Il n\u2019est pas rare que l\u2019employeur propose au travailleur, en lieu et place d\u2019un licenciement pour motif grave, une rupture de commun accord du contrat de travail. La signature d\u2019une telle convention pr\u00e9sente un avantage ind\u00e9niable pour l\u2019employeur : elle cl\u00f4t, en principe, d\u00e9finitivement le dossier. Dans le cas d\u2019un licenciement pour motif grave, l\u2019employeur n\u2019est en effet jamais \u00e0 l\u2019abri d\u2019une contestation de la part du travailleur et, le cas \u00e9ch\u00e9ant, d\u2019une proc\u00e9dure, longue et co\u00fbteuse, souvent incertaine, devant les juridictions du travail. C\u2019est donc tr\u00e8s int\u00e9ressant.<\/p>\n\n\n\n<p><br>Pour le travailleur, c\u2019est une autre histoire. Notamment, parce que consid\u00e9r\u00e9 comme ayant volontairement abandonn\u00e9 son travail, le travailleur s\u2019expose, en cas de rupture de commun accord du contrat de travail, \u00e0 des sanctions au niveau des allocations de ch\u00f4mage, pouvantaller jusqu\u2019\u00e0 52 semaines d\u2019exclusion.
